1. Nature of the service
Movana is a marketplace for paid access to landlord/agent contact and property identity details ("unlocks"). An unlock is not a lease, sale agreement, reservation, or guarantee that a property remains available. Availability, rent, condition, and negotiations are solely between you and the landlord or agent.
2. Account accuracy
You must provide accurate registration details and keep your login secure. You must not create accounts for fraud, scraping, or harassment. Sharing accounts or reselling unlocked contact data is prohibited.
3. Payments and unlocks
Unlock fees are charged via the payment provider shown at checkout. Successful payment grants access to the disclosed details for that listing under Movana's rules. Fees are generally non-refundable once contact details are revealed, except where Movana determines in its discretion that a listing was fraudulent or a technical failure prevented delivery. Chargebacks made in bad faith may result in account suspension.
4. No warranty on third-party listings
Listings are submitted by landlords/agents. Movana does not warrant that photos, prices, amenities, or availability are correct. You should verify the property independently before paying deposits, signing contracts, or transferring funds outside Movana. Never send money to unknown parties based solely on unlocked contacts without due diligence.
5. Acceptable use
You must not abuse unlocks to spam landlords, scrape the catalogue, reverse-engineer the platform, interfere with other users, or use Movana for unlawful discrimination or criminal activity. Automated access without written permission is forbidden.
6. Reporting fraud
If you suspect a fake listing, AI-generated images, or other misinformation, report it promptly through Movana's support channels with evidence. Good-faith reports help enforcement under Landlord Terms (including the KES 100,000 misinformation fine applicable to sellers).
7. Limitation of liability
To the fullest extent permitted by Kenyan law, Movana is not liable for deals that fall through, deposits lost to third parties, property defects, or disputes between buyers and landlords. Movana's aggregate liability related to your use of the buyer service is limited to the unlock fees you paid in the three months preceding the claim.
8. Privacy and communications
We process account and payment metadata to operate the marketplace. Landlords may contact you using details associated with your unlock. See any published privacy notice for further detail.
9. Changes and governing law
Movana may update these Buyer Terms; continued use after notice constitutes acceptance of material updates where permitted by law. Governed by the laws of Kenya; Kenyan courts have jurisdiction. If any clause is unenforceable, the rest remains effective.
