Misinformation fine
Fake houses, AI-generated or mismatched photos, and other material misinformation incur Ksh 100,000 per incident, plus suspension and possible legal referral.
1. Eligibility and identity
You may list properties on Movana only after submitting accurate legal name, national ID, and phone details for verification. You warrant that you are the lawful owner, authorised agent, or otherwise legally entitled to market the property and to disclose contact details to paying buyers. Providing false identity documents, using another person's ID, or impersonating a landlord is prohibited and may be reported to law enforcement.
2. Truthful listings — zero tolerance for fake inventory
Every listing must describe a real, existing property that is actually available on the terms stated. You must not invent properties, recycle unrelated photos, list properties you do not control, or publish "bait" listings designed solely to harvest unlock fees. Listings that are fabricated, withdrawn without notice after unlocks, or materially different from what buyers unlock constitute serious breach.
3. Prohibition on AI-generated and deceptive media
You must not upload AI-generated, heavily synthetic, stock, or otherwise misleading images, videos, or floor plans presented as the actual property. Exterior and interior photos must depict the specific unit or building being offered, taken or obtained with authority to use them. Editing that conceals defects, alters room size, fabricates amenities, or misrepresents location is forbidden. If AI tools are used for non-deceptive purposes (for example cropping), you remain fully responsible for accuracy.
4. Misinformation fine — KES 100,000
Any misinformation in connection with your seller account — including but not limited to fake houses, false availability, false rent or sale price, false location or building identity, AI-generated or mismatched photos, false landlord contact details, or other material inaccuracies that could induce a buyer to pay for access — incurs a contractual fine of Kenya Shillings One Hundred Thousand (KES 100,000) per incident, payable to Movana on demand, without prejudice to additional damages, chargebacks, account termination, forfeiture of pending payouts, and referral to police or regulatory authorities. Movana may deduct amounts owed from any sums otherwise payable to you.
5. Evidence, investigation, and enforcement
Movana may investigate complaints, compare media against known imagery, require proof of ownership or agency, suspend listings, reverse unlocks, and permanently ban accounts. You agree to cooperate promptly. Failure to respond within a reasonable time may be treated as admission for enforcement purposes under these Terms.
6. Buyer unlocks and contact quality
When a buyer unlocks your listing, you must be reachable on the disclosed phone/WhatsApp/email and must not harass, defraud, or redirect buyers to unrelated properties. Selling the same unlocked contact details as a separate scam, or demanding additional "viewing fees" under false pretences, is prohibited.
7. Indemnity
You indemnify and hold harmless Movana, its operators, and affiliates against claims, losses, fines, and costs arising from your listings, media, identity information, or breach of these Landlord Terms — including the KES 100,000 misinformation fine and any third-party claims by buyers.
8. Suspension and termination
Movana may refuse verification, remove listings, or terminate seller privileges at any time for suspected fraud, AI/deceptive media, or breach. Termination does not waive fines or liabilities already incurred.
9. Governing law
These Landlord Terms are governed by the laws of Kenya. Disputes shall first be addressed in good faith; failing resolution, Kenyan courts have jurisdiction. Severability: if any clause is unenforceable, the remainder continues in force.
